Terms and conditions
Last updated on
The French version is the only binding version.
1. Scope
These terms and conditions apply to services provided by BIMMER SERVICE SAS, trading as Askwert Motors (full contact details in the legal notice): servicing, mechanical and electronic repairs, diagnostics, coding and retrofits for BMW and MINI vehicles at the Ostwald workshop, and repair of electronic modules sent by post.
They apply to private and business customers, subject to the specific consumer provisions set out below. Used car sales and sale on consignment presented in the showroom are covered by a separate contract supplied to the customer.
Every order constitutes acceptance of these terms, which take precedence over other documents unless otherwise agreed in writing.
2. Prices
Prices are expressed in euros, inclusive of all taxes (incl. VAT). Prices published on the site are indicative: they cover the most common cases and may vary according to model, engine and vehicle condition. The applicable price is that of the quote or repair order accepted by the customer.
Hourly labour rates and prices for routine services are displayed at the workshop reception.
3. Quotes and repair orders
Before any work, a written quote or repair order is prepared. It specifies the work, parts to be replaced, price incl. VAT and, where applicable, its validity period and diagnostic fees. The order becomes binding when the customer accepts the quote or signs the repair order.
Quotes are free. For major work requiring dismantling or in-depth diagnostics (for example, timing chain or big-end bearing replacement, or a retrofit), and for specific requests or requests covering several jobs, preparing the quote costs €75 incl. VAT. This is paid by bank transfer or a payment link sent by SMS or email, and deducted from the price of the work when it is carried out at the workshop.
If additional work proves necessary during the job, it is carried out only with the customer’s prior agreement, obtained by telephone, message or in writing, on the basis of a price communicated before execution.
4. Parts
Parts used are new, genuine or of equivalent quality, unless the customer agrees to other parts specified in the quote. Replaced parts are retained by the workshop and disposed of or recovered in accordance with regulations.
5. Timescales
Stated vehicle downtime is indicative. It depends in particular on parts availability and findings during the work. The customer is informed of any significant delay.
Please inform the workshop if you cannot attend: a missed appointment without notice may limit future bookings.
6. Payment
Payment is due when the vehicle or repaired module is returned, using the payment methods accepted by the workshop and communicated to the customer. No discount is offered for early payment.
For business customers, late payment automatically incurs penalties calculated at three times the statutory interest rate, together with the fixed recovery costs compensation of €40 provided for by Article L.441-10 of the French Commercial Code.
Under Article 2286 of the French Civil Code, the workshop may retain the vehicle or module until the services provided have been paid for in full.
7. Vehicle handover
The customer is notified when work is complete and collects the vehicle during workshop opening hours. After a reasonable period following this notification, storage charges may apply according to the terms stated in the quote or displayed at the workshop.
The customer checks the vehicle at handover and immediately reports any concerns.
8. Warranties
Services benefit from statutory guarantees: the workshop must carry out the commissioned work to professional standards, and supplied parts benefit from the statutory guarantee of conformity (Articles L.217-3 onwards of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 onwards of the French Civil Code).
In addition, the workshop guarantees its repairs for 2 years, covering parts and labour. This period is reduced to 1 year in certain cases, particularly for reconditioned parts; the applicable period is stated in the quote or invoice.
The warranty does not cover damage resulting from normal wear, misuse, work by a third party or parts supplied by the customer.
9. Module repair by post
Repair of an FRM module sent by post is a distance contract. Before sending it, the customer contacts the workshop by telephone or message to confirm that the module can be repaired without the vehicle (FRM3 version). The repair price and, where applicable, the Colissimo return postage price are communicated and confirmed in writing (email or message).
The customer sends the module correctly packaged, at their own expense and under their responsibility until it is received by the workshop. The repaired module is returned to the address provided by the customer, using the agreed delivery method.
Right of withdrawal (consumer customers)
Consumer customers have 14 days from conclusion of the contract to exercise their right of withdrawal without giving a reason (Article L.221-18 of the French Consumer Code). They do so by sending an unambiguous statement by email or post to the contact details in the legal notice before this period expires, for example using the form below.
If the customer expressly requests that repair begin before this period ends and subsequently withdraws, they pay an amount proportionate to the service provided up to notification of withdrawal (Article L.221-25). The right of withdrawal can no longer be exercised when repair has been fully completed before the period ends, with the customer’s prior express agreement and acknowledgement of the loss of this right (Article L.221-28, 1°).
In the event of withdrawal, the workshop refunds sums paid no later than 14 days after notification and returns the module; return postage remains payable by the customer.

10. Personal data
Data needed to process orders is handled in accordance with the Personal data section of the legal notice.
11. Complaints and mediation
Complaints are sent to the workshop in writing, by email or post. After a written complaint without an amicable resolution, consumer customers may use the CM2C consumer mediator free of charge; contact details appear in the legal notice.
12. Applicable law
These terms are governed by French law. For disputes with business customers, jurisdiction is assigned to the courts covering BIMMER SERVICE SAS’s registered office. Consumer customers may choose the court for their place of residence at the time the contract was concluded or the harmful event occurred, or any other court with territorial jurisdiction.
